Terms of Service

1. Acceptance of Terms

By installing and using Freecaster(the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not install or use the Service.

These Terms apply to all users of Freecaster, including Shopify merchants on both the Free Forever plan and the Premium plan.

2. Description of Service

Freecaster is a Shopify application that provides:

• Demand forecasting based on your Shopify order history
• Inventory alert monitoring with customizable thresholds
• Purchase order creation and vendor communication tools
• Email notification capabilities

The Service is provided as a Shopify embedded application. Use of Freecasteralso requires a Shopify account and is subject to Shopify's terms of service.

3. Account Registration and Access

Access to Freecaster is granted through Shopify OAuth authentication. By installing the app, you authorize Freecasterto access your Shopify store data as specified during the OAuth authorization process.

You are responsible for:

• Maintaining the security of your Shopify account
• All activities that occur through your installation of the app
• Ensuring your use of the app complies with all applicable laws

4. Pricing and Billing

Pricing, billing terms, cancellation, and refund policies are governed by our Pricing Policy, which is incorporated into these Terms by reference.

All billing is processed through Shopify's Billing API.Freecaster does not directly process or store payment information.

5. User Responsibilities

You agree to:

• Use the Service only for lawful business purposes
• Not attempt to reverse engineer, decompile, or disassemble any part of the Service
• Not use the Service to transmit malware, spam, or harmful content
• Not use the Service in any way that could damage, disable, overburden, or impair our servers
• Comply with Shopify's Partner Program Agreement and App Store guidelines

6. Intellectual Property

The Service, including all software, algorithms, user interfaces, and content created by Freecaster, is owned by us and protected by intellectual property laws. Nothing in these Terms grants you ownership rights in the Service.

Your store data (products, orders, inventory levels) remains your property. You grant us a limited license to access and process your data solely for the purpose of providing the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Demand forecasts will be accurate or achieve any particular business outcome
• The Service will meet your specific business requirements

Demand forecasting is an analytical tool. Actual inventory requirements may differ from forecasted values. You are responsible for all purchasing and inventory decisions made using data from the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FREECASTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data or business interruption
• Inventory shortfalls or overstock resulting from forecasting recommendations

Our total liability for any claim arising from use of the Service shall not exceed the amount you paid for the Service in the three months preceding the claim.

9. Termination

Either party may terminate this agreement at any time. You may terminate by uninstalling the app from your Shopify admin. We may terminate or suspend access to the Service for violation of these Terms.

Upon termination, your right to use the Service ceases. Data deletion terms are described in our Privacy Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which our company is registered, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the applicable courts of that jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the app. Continued use of the Service after changes constitutes acceptance of the updated Terms.
